3. Fees for the services we provide

Occasional sellers can benefit from promotional services only after their payment. The request will be made only from the e-mail address that the user used when registering on the ArchiveDeArta and only regarding the amounts that come from the feeds made by the user. ArhivaDeArta may refuse to return, in full or in part, the amount from the account, if there are indications or references that the holder of the request is not the holder of the account. The Organizer reserves the right to apply the measure, according to its own discretionary option or at the request of any authority, without being obliged to justify the action in any way, without being forced to perform another formality and without having to justify the reasons.

Will the refund of the amounts that have been fed by sms be made directly from the mobile operator? The user will send a request to return the money directly to the operator, following which the operator will? goes to the payment processor to check to what extent the requested amounts were used or not in the ArhivaDeArta website. In case the payment processor will confirm the return of the amounts, the operator will proceed to return the amounts, according to his own rules. 4.8.2. Infringement, in any way and to any extent, of these provisions will implicitly lead to the exercise by the Organizer of the right to eliminate, in whole or in part, inappropriate questions, answers and / or private discussions and email alerting the person in question . 5.1. Automatic import

Since, at the time of performing the Automatic Import, there may be interruptions in the transmission of the information, ArhivaDeArta assumes in no way and in no way the responsibility regarding the correctness of the information inserted using the Automatic Import option. The ArhivaDeArta user who uses the automatic import has the obligation to verify that the data of his products are accurate and complete. 6. Delivery Guarantee Service

6.1 Terms used in the regulation

6.2.2 Liability of the parties involved

6.2.3 As a seller, the user has the following obligations

The seller has the obligation to send the parcel through the courier service, generating the transport document for delivery at the end of the transaction through the Site and to keep the documents related to the shipment. 17. If the product is returned, the seller will be able to claim the quality of the product, if it does not correspond to that of the product originally sent or the product does not correspond to the initial one, within 10 working days from the moment that status the transaction becomes "Returned consignment", using the support system "GdL with delivery by special couriers", made available by ArchiveDeArta. Otherwise, the return will be considered realized and the amount paid by the buyer for the transaction will be returned to him.

18. 19. The seller has the obligation to correctly fill in the address and the data of the sender on the parcel sent. 6.2.4 As a buyer, the user has the following obligations

25. The successful completion of the transaction determines the payment to the seller in the next business day, but not earlier than the entry of the money corresponding to the transaction in the ArchiveDeArta account, and the termination of any debts and obligations from the buyer to the buyer and from the buyer to it. 26. 30. The buyer has the obligation to send the return parcel (back to the seller), using the agreed courier services. Also, the buyer has the obligation to keep the documents related to the shipment of the parcel and the registration number of the parcel in order to verify it through the tracking system made available by the approved courier service. In the case of the claim of the non-return of the return by the seller, in the absence of the documents related to the shipment of the parcel, the transaction will be considered successfully completed. The cost of transport for returning the parcel is the responsibility of the buyer.

31. In the case of claiming the non-return of the return parcel by the seller, the buyer has the obligation to submit within 7 working days, starting with the day the status of the transaction becomes? The transaction will be closed without a payment registered in the system.

6.3 The role of the ArchiveDeArt and the courier service

6.3.1ArchiveDeArt and service? Delivery Guarantee?

35. ArhivaDeArta will fulfill several functions, being in different relationships with the users, the representatives of the courier services approved or third parties.

36. ArhivaDeArta will have the quality of service provider towards users, providing them with an online platform in order to facilitate the sale of products by users in their own name. In this report, ArhivaDeArta will have the following obligations: (a) to ensure the proper functioning of the system made available to users; (b) to ensure the notification of the users regarding the changes in the status of a transaction. Notifications can be made both through the notification system developed by ArhivaDeArta, as well as by e-mail; (c) display the current version of this document and the date it was published on the Site.

37. ArhivaDeArta will have the capacity of agent in the relations with the users, reports that have as object amounts of money paid with the title of price. In this capacity, ArhivaDeArta will collect the amounts of money from the buyer, on behalf and on behalf of the seller, based on their instructions. By accepting this document, the sellers who opt for the service? GdL with delivery by special couriers? mandates ArchiveDeArta to collect and retain for a certain period of time the amounts that buyers pay as price to the sellers and allow ArchiveDeArta to subordinate third parties for the purpose of fulfilling the main mandate object. ArhivaDeArta will collect and retain these amounts of money only as a trustee, being not the holder or the actual beneficiary of the amounts of money. ArhivaDeArta receives the mandate from its users to guarantee the smooth and correct operation of the transactions through the Website. As an agent, ArchiveDeArta will have the following obligations:

(a) to collect the amounts of money received from the users, in his account;

(b) not to use the amounts received from users for their own benefit;

(c) to transfer the amounts corresponding to the transaction in accordance with the provisions of this Regulation and with the documents provided by the users involved in the transaction;

(d) To process the payments to the users of the Delivery Guarantee service involved in a completed transaction, on the next Thursday? the date on which the ArhivaDeArta account will have been supplied with the amount paid by the buyer. Will ArhivaDeArta keep the amounts of money received by price as a result of activating the service? GdL with delivery by special couriers? only for the periods and only in the situations provided for in this document. In no other situation and for no other reason will the ArhivaDeArta receive other amounts of money, than in the situations expressly provided for and regulated by the terms and conditions of the ArhivaDeArta site.?

6.3.2 The role of the approved courier service provider

38. The courier service provider will be in different relationships with the users, the ArchiveDeArta or third parties.

39. Compared to the users of ArhivaDeArta and in the reports regarding the packages, the courier service provider will fulfill the function of carrier. In this regard, the service provider will have the obligation to transport the parcel from the seller to the buyer, to issue the transport document or to allow its issuance by the sender through the AWB system of the courier service provider, as the case may be, to complete the correct transport document, complete, with all the data received from the sender (only if so agreed by the parties by the service provision contract concluded between ArhivaDeArta and the courier service provider; otherwise, the document will be completed by sender). As a carrier, the courier service provider will be subject to the legal provisions regarding freight, and may be held liable in accordance with the aforementioned legal provisions.

40. In the reports that have as object the receipt of certain amounts of money, the courier service provider will have the quality of subordinate to users and agent to ArchiveDeArta. Thus, in order to fulfill the mandate received from users, ArhivaDeArta sub-empowers the courier service provider in order to receive the amounts of money, following which the courier service provider will transfer them to the ArchiveDeArta, where these amounts will be withheld according to the provisions of this document. In this sense, the courier service provider will collect the amounts of money from users in the name and on behalf of ArchiveDeArta, which will collect in its name and on behalf of the user. By accepting this document, the users grant ArchiveDeArta the possibility to submit to the service provider the obligation to collect the amounts of money paid by users as a price. As a subcontractor, the courier service provider has the obligation to receive the amounts of money from the users and to transfer them to the ArchiveDeArta, just as he received these amounts. Both the users and the ArchiveDeArta will be able to hold the courier service provider responsible according to the legal provisions stipulated by the legislator for the mandate.

41. For return shipments, the standard rates of the courier companies apply

6.4 Payment system for the Delivery Guarantee service

42. The reimbursement payment will be made directly to the courier service representative, at the moment of receipt of the parcel by the buyer.

43. The transport costs will fall to the buyer, both in case of delivery of the product and at the time of return of the product.

44. In case the buyer will be given an incorrect address, without or with this intention, then the cost of the shipment will be borne by the seller. Under no circumstances shall ArhivaDeArta be obliged to bear any expenses resulting from the transport of the products between its users.

45. ArhivaDeArta acts as a guarantor of transaction security. ArhivaDeArta will retain the amounts of money collected from the users until the conditions are fulfilled to turn the money over to one of the parties to the transaction.

46. The interest that the amounts of money accumulate in the ArhivaDeArta account belongs to ArhivaDeArta.

47. In the case of the seller, will the ArchiveDeArta release the money to him on the next Thursday? the date on which the buyer confirmed the quality of the product, but not earlier than the entry of money into the ArchiveDeArta account.

48. The ArhivaDeArta commission will be fully supported by the seller, under the conditions of art. 3.3 of the Terms and Conditions. The amount corresponding to this commission will be withheld from the price of the product and will be identified in the user's account as a supply.

49. For all deliveries made within the GdL service through the DPD courier or through the Romanian Post, the transport cost will be withdrawn from the seller's user account and the corresponding amount will be withheld from the price of the product and will be identified in the user's account as a supply. . For deliveries made through the FanCourier courier, the shipping cost will be paid to the agent, in cash, upon delivery of the parcel.

50. In the case of shipments made through the courier service provided by the Romanian Post, the Seller must comply with the following obligations:

This sanction has the immediate effect of limiting the maximum price at which the seller has the right to put a product for sale.

52. If the seller is in the second deviation, then he will be permanently suspended from the Delivery Guarantee service, which will have an effect on the maximum sale price at which the seller wishes to post a product. Thus, if the seller wants to put on sale a product that has as a starting price a price higher than the maximum price that he has the right to display, then the seller will have to activate the "personal delivery" option.

53. ArhivaDeArta has the right to sanction any such facts, but not the obligation to do so. The sanctioning of its users remains at its discretion, with the ArhivaDeArta having discretionary power in taking the necessary coercion measures against the users who violate this regulation.

6.6 Final provisions

54.
